Please read these Terms of Service (“Terms”) carefully before using NDIStress. By creating an account, purchasing a membership, booking a session, or otherwise using our website, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. About us
NDIStress (“we”, “us”, “our”) operates an Australian online platform providing governance and compliance education, live consultations, and supporting resources for NDIS providers and workers. You can contact us at info@ndistress.com.au.
2. Eligibility
You must be at least 18 years old and legally able to enter a contract under Australian law to use NDIStress. By registering, you confirm that the details you provide are accurate and that you will keep them up to date.
3. Accounts
- You are responsible for all activity under your account.
- You must keep your password confidential and not share your login with any other person.
- You must notify us immediately at info@ndistress.com.au if you suspect unauthorised access.
- We may suspend or terminate accounts that are shared, misused, or used to infringe these Terms.
4. Memberships and billing
- Recurring subscription. Memberships renew automatically at the end of each billing period (weekly, monthly, quarterly or yearly, depending on the plan you select) until you cancel.
- Price changes. We may change membership prices, but not for an active billing period. We will give at least 14 days’ notice by email before a price change applies to your renewal.
- GST. Prices are quoted in Australian Dollars (AUD) and include GST where applicable. A valid tax invoice is issued by email after each successful charge.
- Cancellation. You can cancel at any time from your dashboard or the Stripe customer portal. Cancellation takes effect at the end of the current paid period — you keep access until then.
- Refunds. Because access is granted immediately on payment, subscription fees are generally non-refundable for partial periods. Your statutory rights under the Australian Consumer Law are not affected.
- Failed payments. If a renewal fails, we will retry the charge and notify you. Access may be paused until payment succeeds.
5. One-on-one bookings
- Confirmation. A booking is only confirmed after payment is captured by Stripe. You will receive a confirmation email with the session details.
- Rescheduling. You may reschedule free of charge up to 24 hours before the session start time, subject to lecturer availability.
- Cancellation by you. Cancellations made at least 24 hours before the session are eligible for a full refund. Cancellations within 24 hours are non-refundable except where required by law.
- No-shows. If you do not attend a scheduled session and have not cancelled, the session is forfeited and no refund is payable.
- Cancellation by us. If a lecturer must cancel, we will offer you either a reschedule or a full refund. We will notify you as early as possible.
- Conduct. Sessions are for the registered member only and may not be recorded, livestreamed, or re-distributed without the lecturer’s prior written consent.
6. Video Library and educational content
- The video library is licensed for your personal, non-commercial use while your membership is active.
- You may not download, copy, screen-record, re-upload, publicly display, or otherwise redistribute the videos or any other content on the platform.
- We use signed URLs and other technical measures to enforce this. Circumventing these measures is a serious breach of these Terms and may result in immediate termination and legal action.
- When your membership ends, your licence to access the video library ends too.
7. Nature of the content — not professional advice
NDIStress content, including the video library, the NDIS Stress Check, and one-on-one consultations, is provided for educational and informational purposes only. It is general in nature and does not constitute legal, medical, psychological, financial, or other professional advice. You should consult an appropriately qualified professional before acting on anything you learn from us. Reliance on the content is at your own risk.
8. Acceptable use
You must not:
- Use the service to break any law or for any unlawful purpose.
- Upload or transmit malware, viruses or harmful code.
- Attempt to gain unauthorised access to any part of the platform or another user’s account.
- Scrape, crawl, or systematically harvest content or data.
- Impersonate any person or misrepresent your affiliation with any organisation.
- Use the platform to harass, threaten, or defame any person, including our lecturers and staff.
- Resell or commercially exploit the service without our written permission.
9. Intellectual property
All content on NDIStress — including branding, text, videos, audio, graphics, code, and learning materials — is owned by NDIStress or its licensors and is protected by Australian and international copyright laws. We grant you a limited, non-transferable, revocable licence to use the platform for its intended purpose while you hold an active account.
10. Your content
If you submit notes, questions, feedback, or other content to the platform, you grant us a worldwide, royalty-free licence to use, store and display that content for the purpose of operating the service. You remain the owner of your submissions. You are responsible for ensuring your submissions do not infringe anyone’s rights.
11. Availability and support
We aim for the platform to be available 24/7 but do not guarantee uninterrupted service. Scheduled maintenance will be announced where practical. Support is offered by email during Australian business hours.
12. Consumer guarantees
Nothing in these Terms excludes, restricts or modifies any consumer rights you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, it is limited, at our option, to re-supplying the service or refunding the fees paid for it.
13. Liability
To the maximum extent permitted by law, and subject to the consumer guarantees in Section 12, NDIStress is not liable for indirect, incidental, special or consequential losses, including loss of profits, revenue, goodwill, or data, arising from your use of the platform. Our total liability for any direct loss is capped at the fees you paid us in the 12 months before the event giving rise to the claim.
14. Indemnity
You agree to indemnify NDIStress against claims, losses, and expenses arising from your breach of these Terms, your misuse of the service, or your infringement of any third party’s rights.
15. Suspension and termination
We may suspend or terminate your account (without refund) if you materially breach these Terms, pose a security risk, or use the service fraudulently. You may terminate your account at any time by cancelling your subscription and emailing us a deletion request.
16. Changes to these Terms
We may update these Terms from time to time. For material changes, we will notify registered members by email at least 14 days before the change takes effect. Continuing to use the service after the effective date constitutes acceptance of the revised Terms.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and NDIStress submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
